We had a pretty good laugh tonight; Walmart better watch out!
Every evening, we gather a group of 7-9 gentlemen to watch an hour of cable news. We usually start off with Laura Ingram, jump to Rob Schmitt and occasionally check in with Joy Reid and Erin Burnett. Tonight on Joy Reid’s show, there was some hand wringing over Presidential Pardons, and how Justice John Roberts said that the legislature couldn’t do anything about the pardon power, because it is essentially absolute. He is right…over history, lots of pardons have been objectionable. While there is some tradition and precedent involved, there have been some real eyebrow raising pardons for people who committed some serious crimes…
However, the Pardon power, granted to ‘the people’s’ sole representative, the Office of the President, is Equities’ last stand. Equity deals with the intercourse of men with men (living people with living people)(US Constitution: article 3, paragraph 2, “…the judicial power shall preside in all cases of LAW and EQUITY). There are times that the legislatures write bad LAW There are times that prosecutors violate living people’s rights under color of LAW. There are times Judges follow the LAW despite their ‘better judgement’. The LAW is held sacrosanct, as it should and those who have taken an Oath to it will follow it, even when IT, the LAW, does injury.
Well meaning legislatures, prosecutors, judges and other constitutional officers can actually do harm and injury in the name of the LAW. There are times where the LAW fails, where the coldness and in-human LAW can injure. Our founding fathers left one final check on the power of LAW. The people, through the Pardon power, in an act of Equity, can extend a Pardon to those who are injured by LAW. The Pardon Power is the check and balance to THE LAW, it was designed as such, it was bestowed on ‘the people’s’ sole representative, the President. The Pardon power ensures that a living being, a Moral Sentient Being can provide ultimate remedy where the LAW fails.
Tonight, we had a good laugh, because Joy Reid, while acknowledging the ultimate authority of a President to extend a Pardon, made mention that Donald Trump was about ‘to pardon over 1,000 violent insurrectionists’, and ‘they will be released back into the community and will cause all kinds of trouble at your local Walmarts and with Local Law enforcement’. LOL, the whole group laughed, sitting in on this news hour with two very docile J6ers. Everyone looked at us and laughed, we are like Lambs among Wolves in here!
When dealing with pardons, and the politics of pardons, it is best to remember the phrase: “Better ten guilty men go free, then one innocent man be imprisoned”. There will always be eye raising pardons, there will always be those, who for their ‘connections’ received undeserved pardons…but to those few (or in January 6 cases, the thousands) who DO deserve a pardon, it’s a price worth paying…Just ask someone like Alice Johnson, Mike Flynn or Roger Stone…We should never lobby for the pardon power to be diminished, it is Equities last stand, it is ‘the people’s last remedy.

*In our modern political climate, DEI (Diversity Equity and Inclusion) has given Equity a bad name. Equity is a form of Equality, but Equality is not Equity. The word Equity has been hijacked, 90% of the time, when you hear Equity in the media, or some pundit dismissing Equity, they MEAN Equality. Equity IS constitutional, Equality is not. Equity is a starting point, Equality is a finishing point. Equity is also a specific jurisprudence that was merged in our federal courts in 1938, then with the adoption of the rules of Criminal and Civil Procedure later one to simplify thing. Equity and Equality are different, we should be wise to correct those who say Equity, when they mean Equality.
